Before launch Draft. This document is a working draft written alongside the product. It has not been reviewed by a lawyer and is not yet a binding agreement. Placeholders marked in square brackets need the operating entity's details before launch.

1. Who these terms are between

These terms govern your use of LocateAU and this website, operated by [legal entity name], ABN [ABN]. Creating an account means you accept them on behalf of yourself and any organisation you name on the account.

2. Your account

You are responsible for the accuracy of the details on your account and for everything that happens under your API keys. Keys are secrets. Do not embed them in a public repository, a mobile app binary, or client-side JavaScript that a third party can read.

Tell us promptly if you believe a key has been exposed. You can revoke any key yourself from the dashboard at any time.

3. Acceptable use

You may query the API for legitimate business purposes in your own products and internal systems. You may not:

  • systematically extract the underlying dataset, or attempt to reconstruct a substantial part of it, whether by bulk enumeration of identifiers or otherwise;
  • resell, sublicense or redistribute raw address records as a competing dataset or address service;
  • use the service to build a profile of a person at an address beyond what your own lawful purpose requires;
  • circumvent quotas, rate limits or authentication, or share a key across unrelated organisations.

Storing the results of your own queries for use inside your own product, including caching identifiers and matched addresses, is expected and permitted.

4. Address data and its source

Address data is derived from the Geocoded National Address File (G-NAF) Core, published by Geoscape Australia and made available under its open licence terms. Your use of results is subject to those upstream licence terms, which sit alongside these terms rather than being replaced by them. Geoscape Australia does not endorse LocateAU.

A successful match means an address is present in G-NAF. It is not a certification of postal deliverability, occupancy, land title, or of anything else about the premises. See the coverage information on the homepage for what the data does and does not assert.

5. Plans, quotas and billing

Paid plans are billed monthly in advance in Australian dollars through Stripe. Quotas apply per calendar month and reset at the start of each billing period. Requests beyond your quota are rejected rather than billed as overage.

You can cancel at any time from the billing portal. Cancellation takes effect at the end of the current period, and we do not refund partial periods unless the law requires it.

6. Availability and support

We aim to keep the service running and to give reasonable notice of planned maintenance. There is no contractual uptime commitment or service credit scheme at this stage. If you need one, talk to us before you build a critical dependency on the API.

7. Changes to the API

We may add endpoints and fields. Where a change would break an existing request or response contract, we will version it rather than change /v1 underneath you. Deprecations will be announced with notice by email to account holders.

8. Suspension

We may suspend an account or revoke a key where use breaches section 3, where payment has failed, or where continued access would put the service or the underlying licence at risk. Where circumstances allow, we will contact you first.

9. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law. Subject to that, the service is provided as is, and our aggregate liability is limited to the fees you paid in the twelve months before the claim. We are not liable for indirect or consequential loss, including loss of profit or data.

Address matching is probabilistic on messy input. You are responsible for deciding what score and match quality is good enough for your use, particularly where a wrong address has physical or financial consequences.

10. Governing law

These terms are governed by the laws of [state or territory], Australia, and the courts of that jurisdiction have exclusive jurisdiction.
